Lahore High Court Issues Key Ruling on Underage Girl’s Marriage

The Lahore High Court has issued an important ruling concerning the marriage of an underage girl, stating that under the Punjab Child Marriage Restraint Act 2026, the marriage of anyone under the age of 18 is illegal.

During the proceedings, the court learned that Hina Aslam was approximately 15 years old at the time of her marriage. In light of new evidence presented before the court, the Lahore High Court directed police to conduct an investigation in accordance with the law.

The court also set aside the decision of the Justice of Peace, who had rejected a request for registration of a criminal case. Police were directed to examine the new evidence and determine whether a punishable offence had been committed.

According to the court’s ruling, the applicant had previously registered a case concerning the alleged abduction of his daughter. However, the court clarified that if new facts or evidence emerge, there is legal scope for registration of another First Information Report (FIR).

The Lahore High Court further ordered that Hina Aslam be placed under the care of the Child Protection and Welfare Bureau. Relevant authorities were directed to ensure her immediate safety, welfare and best interests.

The court observed that a child’s wishes are important, but because of the child’s young age, her opinion cannot automatically be considered decisive in every matter.

The judgment emphasized that the primary purpose of laws against child marriage is to safeguard children’s rights, protection and welfare.

The court directed police and other relevant institutions to take all necessary measures to protect the girl and proceed with the matter strictly in accordance with the law.

The ruling highlights the importance of protecting children from underage marriages and ensuring that their safety, welfare and fundamental rights remain a priority in legal proceedings.
